SSS sustains campaign vs erring employers

KALIBO, Aklan (PIA) --The Social Security System urged employers in the private sector to be consistent in the remittance of contributions of their employees.

Vice President for SSS VW 2 Division and RACE team leader Bernardo B. Dofitas said that RACE is a nationwide project OF the SSS which they have conducted for more than five years already.

This ensures the continuous compliance of delinquent employers with their statutory obligations under Republic Act No. 11199 or the Social Security Act of 2018.

“Our main purpose is to visit identified employers who have delinquency obligations to the SSS. Under the law, every employer is required to remit the Social Security Contributions of the employees immediately on the first day of his/her employment. The same should be paid the following month by the employer and it is an obligation imposed by the SSS Law or Republic Act 11199,” said Dofitas, adding that such law is enforced to all kinds of businesses, from single proprietorship to partnerships to corporations with even at least one employee.

“Here in Panay, we are tasked to conduct the same and our purpose is not only to enforce the Social Security Law but also to educate our employers that the SSS is here not only to enforce the law but to educate them and inform the employees as well of their rights,” he noted.

The RACE team visited seven business establishments in Kalibo and handed them a Notice of Violation, providing the employers 15 days to comply and settle the unpaid contributions.

Chief Executive Officer II Elmer B. Sendico of Employer Delinquency Monitoring Department of SSS WV Division and also part of the RACE team explained that prior to conducting RACE activity, the accounts services section of the branch sends the billing to the employers and makes follow-ups. If the employers failed to comply despite notices, their candidacy for RACE will follow.

“Today, the approach of SSS is more on persuasion rather than litigation. This is a different approach. Before we file a case, we have to exhaust first all the means for the employers to comply by convincing and persuading them to pay and settle their obligations as the employees are affected. So, if the employers still do not comply, this will be the time that we serve notice of violation and will be our basis to elevate their delinquency to the court,” Sendico explained.

Meanwhile, Dofitas confirmed that more than 90% or almost all of the employers in Aklan who were subjected to RACE before have complied and have not since been subjected to RACE again.

Based on the report of SSS, most of the reasons for the delinquency of employers for non-payment was due to busyness and such had been addressed by the agency.

“Actually, SSS little by little transformed into digital mode of compliance with the SSS Law. Aside from we have our tellers that accept payment at the SSS branches or other banks, there are also Bayad Centers and online platforms now where payment could be through Gcash and UnionBank,” Dofitas said.  

In encouraging employers to settle their delinquencies, SSS is offering contribution penalty condonation programs such as Contribution Penalty Condonation, Delinquency Management, and Restructuring Program (CPCoDe MRP).

The team clarifies that RACE is not something to be afraid of as this only serves as a reminder to the employers and SSS is always available to assist both employers and employees. 

Joining the team during the RACE activity in Kalibo were Senior Communications Analyst Amiel Y. Genova of SSS-VW 2 Division, and from SSS-Kalibo were Branch Head Lea Hilot, CEO II Rey Mark Casaquite, information officer Stephany Joy Espino and account officers Joslyn Jizmundo and Glenn Torres. Also in attendance were PIA-Aklan and members of the Aklan media.
